Terms of service

These General Terms and Conditions of AM Drip AG as the seller and you as the customer apply to all orders in the AM Drip online shop (www.amdrip.com) as well as for those purchases where AM Drip AG declares these GTC applicable.

Scope of Application The GTC apply to all services provided by AM Drip AG in the online shop (www.amdrip.com) and become valid upon the conclusion of a contract. Deliveries, services, and offers from AM Drip AG are made exclusively based on these GTC, even if they are not expressly agreed upon again. By sending an order to AM Drip AG, you confirm that you have read the present GTC and expressly agree to them. AM Drip AG is entitled to adjust these GTC at any time. The GTC published at the time of the conclusion of the contract shall apply.

Conclusion of a Contract All information about goods and prices within the order process is non-binding and without obligation. Orders are binding for customers. Therefore, orders cannot be changed or canceled. Customers receive a non-binding confirmation from the seller for orders. Before the notification of shipment, through which the contract with the seller is concluded, AM Drip AG can withdraw its offer without further notice. By placing your order, you confirm that you are aware of the scope and content of your order. Questions in this regard can be clarified with us in advance.

Delivery The delivery of goods is generally carried out by post or courier. Delivery of goods usually takes place within 2 to 5 working days unless otherwise stated for the respective product. These details are without guarantee. In the case of incorrect or unclear address details or non-acceptance of the shipment, the return costs charged by the post office or courier must be borne by the customer. Upon handover of the goods to the post office or courier, the risk is transferred to the customer, and any liability of AM Drip AG is excluded. Thus, AM Drip AG does not bear the transport risk.

If an item in the assortment is exceptionally not deliverable, we will inform you via email. AM Drip AG reserves the right to make partial deliveries if this seems to be efficient for the overall delivery. In such cases, no additional shipping costs will be charged for the subsequent delivery.

Prices All prices on www.amdrip.com include the legally required VAT in Switzerland (currently 8.1%) and include shipping costs (for shipping to Switzerland and the Principality of Liechtenstein). AM Drip AG expressly reserves the right to adjust the online prices at any time without notice and without giving reasons. The calculation of prices is based on the time of the order on the website.

Shipping Costs

There are no additional costs for shipping your goods; you benefit from free delivery within Switzerland and Liechtenstein.

Payment Conditions The following payment options are available to you:

  • Purchase on account (POWERPAY)*
  • Credit card (Visa & Master)
  • Debit card (VPay, PostFinance, and Master)
  • Twint

*Purchase on account with the option of partial payment (POWERPAY) MF Group / POWERPAY offers the "purchase on account" payment method as an external payment service provider. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified timeframe, you will receive a monthly invoice with an order overview in the following month.

When concluding the purchase contract, POWERPAY takes over the invoice claim and handles the corresponding payment modalities. By purchasing on account, you accept, in addition to our GTC, the GTC of POWERPAY, and AM Drip AG is free from any obligation in this regard.

Retention of Title; Set-off; Right of Retention

  1. For consumers, we retain ownership of the purchased item until the invoice amount is paid in full. If the customer is an entrepreneur in the exercise of a commercial or independent professional activity, a legal entity under public law, or a special fund under public law, we retain ownership of the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
  2. You are only entitled to set off if your counterclaims are legally established or undisputed or acknowledged by us. You also have a right of retention only if and to the extent that your counterclaim is based on the same contractual relationship.
  3. If the customer is in default with any payment obligations towards us, all existing claims shall become due immediately.

Warranty and Guarantee The warranty for goods corresponds to generally accepted standards and is 24 months from the date of purchase unless a longer or shorter warranty period is expressly stated on the delivered goods. Defective goods must be reported in writing to the company address within 10 days of delivery or occurrence of the damage; otherwise, the warranty claim shall expire. The warranty claim is valid from the delivery date. It expires in case of improper use or natural wear and tear. Period underwear must be washed at no higher than 40 degrees and each time on a gentle cycle, and the other care instructions listed on the product or in the product packaging must be followed. AM Drip AG reserves the right to decide individually in the event of a warranty case. Warranty and guarantee are excluded for items declared as outlet goods.

Return Guarantee Every customer has the right to return received items (except vouchers) to AM Drip AG within 14 days. Returns must be sent back in an unused, hygienically perfect, and otherwise unimpaired condition according to our shipping and return conditions; otherwise, the right to return expires. For returns, the shipping costs incurred by AM Drip AG will be charged to the buyer or deducted from the refund amount. Return shipping costs must be borne by the buyer. By accepting the GTC, you automatically accept our return conditions. Items declared as outlet goods and vouchers are explicitly excluded from the return guarantee.

Minor Model Deviations It happens that the design of individual items changes slightly. AM Drip AG cannot assume any liability for such modifications by manufacturers and suppliers.

Care/Handling AM Drip AG assumes no liability for the customer's misconduct in the care and/or handling of the delivered items.

Data Protection AM Drip AG undertakes to handle your customer data carefully and to comply with the provisions of the relevant data protection laws. In particular, no data will be passed on to third parties. However, no liability can be assumed for the security of data transmitted over the Internet. Our privacy policy explains in detail how we handle data.

Marketing AM Drip AG reserves the right to use the email address and phone number provided when ordering for its own marketing purposes (newsletters and others). You can opt-out at any time by sending a personal email to info@amdrip.com.

Product Reviews AM Drip may send automated emails after purchase, requesting customers to review the purchased products. AM Drip reserves the right to use customer reviews and other reviews (without email request) for marketing purposes.

Vouchers and Discount Codes

There is a general distinction between gift vouchers and discount codes. Gift vouchers can be used multiple times within the valid period of three years until their voucher amount is exhausted. This is excluded for discount codes. The payout of gift vouchers and discount codes is excluded.

Personal vouchers and discount codes, which are created only for a specific person or group, may not be passed on and may only be redeemed by persons authorized by AM Drip AG. AM Drip AG reserves the right to cancel all unauthorized orders without comment. Only one discount code can be used per order.

General Liability It is expressly stated that no liability claims can be made against AM Drip AG for direct and indirect as well as immediate and indirect damage, including consequential damage, by the customer, provided that there is no intent or gross negligence on the part of AM Drip AG for the damages incurred. For example, damages from accidents, falls, etc., resulting from the handling of AM Drip products are your own responsibility.

Applicable Law/Jurisdiction In any case, the relationship between you and AM Drip AG is subject to Swiss law, excluding the conflict of laws rules of private international law. The place of jurisdiction is Zurich. The application of the provisions of the Vienna Sales Law ("United Nations Convention on Contracts for the International Sale of Goods") is expressly excluded.

Severability Clause Should individual provisions of this contract prove to be invalid, this shall not affect the remaining provisions of this agreement. In this case, the invalid provision is to be replaced by a new regulation that corresponds to the intended purpose or, if this is not possible, comes as close as possible to it.
